URBAN PATIO TERMS OF SERVICE

Urban Patio may provide the following services, depending on the package or written proposal selected by the customer:
Outdoor-space consultation and design direction;
Balcony, patio or terrace layout planning;
Custom seating concepts and furniture coordination;
Selection of fabrics, cushions, finishes, textures, rugs, lighting, planters and décor;
Plant styling, indoor/outdoor greenery and edible home-garden design;
Optional pet-friendly or family-friendly design recommendations;
Sourcing or coordination of products from third-party suppliers or makers;
Delivery coordination and styling or setup support;
Design mood boards, sketches, recommendations and visual concepts.
The exact services included in your project will be stated in your quotation, invoice, approved proposal or written service agreement. Any service not stated in the approved scope is not included unless later agreed in writing.

Every Urban Patio project begins with a consultation and site visit. This allows us to understand your outdoor space, layout, measurements, sunlight conditions, style preferences, intended use, access requirements and any practical considerations that may affect the design.
During the consultation and site visit, we take time to understand your vision and assess what is possible for your balcony, patio or terrace. This step helps us recommend suitable furniture, custom seating, plants, fabrics, materials, lighting, storage and finishing touches that work for your home.
The consultation and site visit are carried out before a complete and accurate project quotation can be provided. Because each space, design vision and selection of products is different, the final scope of work and total project cost will only be confirmed after we have assessed the property and prepared a personalised proposal.
Unless otherwise stated in writing, the consultation and site visit do not include the purchase of furniture, custom seating, plants, materials, décor, delivery, installation or final styling services.
You are responsible for providing safe access to the property and informing Urban Patio of any building rules, landlord approvals, balcony limitations, delivery restrictions or other requirements that may affect the project.

Once we understand your requirements, Urban Patio may prepare a concept, mood board, product selection, plant plan, layout, quotation or project proposal.
Before products are ordered, custom pieces are created or delivery arrangements are made, you will be asked to approve the relevant design direction and cost.
Once approved:
Custom-made or specially sourced items may not be changed without additional cost;
Changes requested by you may require a revised quotation and new timeline;
Work will only proceed once any required additional payment is made;
Availability of plants, textiles, furniture pieces and décor may change before purchase.
We will make reasonable efforts to match approved concepts, but natural materials, handmade pieces, plants, fabric batches, wood grains, colours and textures may vary slightly. These variations are part of the character of curated and natural products and do not automatically amount to a defect.

Urban Patio offers personalised patio and balcony transformation services created around each customer’s space, lifestyle and design vision.
Our patio transformation projects generally start from approximately KSh 80,000 to KSh 100,000, depending on the size of the space, design requirements, furniture selections, custom pieces, plants, materials, delivery needs and finishing details chosen for the project.
This starting range is provided as an initial guide only. It is not a final quotation, guaranteed total cost or confirmation that every project can be completed within that amount.
After the consultation and site visit have been completed, Urban Patio will prepare a personalised proposal and accurate quotation setting out the recommended scope of work and applicable costs. The quotation may include, where relevant:
Custom seating, furniture and outdoor furnishings;
Fabrics, cushions, rugs and weather-suitable materials;
Plants, planters, edible garden items and garden styling;
Lighting, storage, decorative pieces and finishing touches;
Delivery, setup, installation or styling support; and
Any additional services requested and approved by you.
No furniture, materials, plants, custom items, delivery arrangements or project work will be ordered or confirmed until you have reviewed and approved the relevant proposal or quotation in writing.
Once a quotation has been approved, any requested additions, substitutions, design changes or extra services may result in an updated quotation, revised timeline or additional charges. Urban Patio will seek your approval before proceeding with any material change to the approved scope or pricing.
A deposit or full payment may be required before products are sourced, custom items are commissioned, suppliers are booked or delivery arrangements are made. The required deposit, payment schedule and balance due dates will be shown in your approved quotation or invoice.

Certain projects may include custom seating, made-to-order pieces, selected fabrics, planters, rugs, décor, plants or edible garden items.
Because these items may be sourced or prepared specifically for your project, cancellation or return options may be limited once an order has been confirmed, materials have been purchased or custom work has begun, subject always to your rights under applicable Kenyan law.
For plants and edible-garden installations, we carefully select plants suited to the stated space and conditions. However, plants are living items and their ongoing health depends on watering, sunlight, temperature, pests, pruning, maintenance and customer care after handover. Urban Patio does not guarantee continued plant survival after delivery unless a separate maintenance service is agreed in writing. This does not affect responsibility for plants delivered in damaged, diseased or unacceptable condition.

Delivery day is when your selected pieces begin to come together and your new outdoor space starts to take shape.
Where delivery coordination forms part of your package, Urban Patio will make reasonable efforts to ensure furniture, plants, décor and other approved pieces are delivered carefully and within the agreed timeframe. Delivery dates are estimates unless expressly confirmed as fixed in writing.
You agree to ensure that:
Access to the property is safe, clear and available at the agreed time;
Building entry, parking, lift access and delivery permissions have been arranged;
A responsible adult is available to receive the delivery, where required;
The space is prepared and cleared before styling or setup begins.
Urban Patio will not be responsible for delays caused by supplier delays, courier delays, severe weather, building restrictions, inaccessible premises, customer unavailability, events outside our reasonable control or failure to obtain required property permissions.
Any visible damage, missing item or delivery concern should be reported to Urban Patio within [24/48] hours of delivery, with photographs where applicable, so that we can review and assist promptly.

You may cancel a consultation or design appointment by providing at least 48 hours’ notice before the scheduled appointment. Late cancellations or missed appointments may result in the consultation fee being retained or charged.
For design work already completed, approved plans, sourced items, purchased materials, confirmed supplier orders or custom-made products, refunds may be reduced to reflect work completed and costs already incurred.
Where a product is defective, damaged on delivery, materially different from what was approved, or where a refund or cancellation is required by applicable consumer law, Urban Patio will handle the matter in accordance with the applicable legal requirements.
Nothing in these Terms is intended to remove or limit any right that a customer has under Kenyan consumer protection law.

Urban Patio designs and styles spaces for residential enjoyment, but you remain responsible for the lawful and safe use of your home and outdoor area.
You are responsible for checking any restrictions relating to building rules, lease terms, structural limits, railing safety, child safety, pet safety, fire safety, electrical installations, drainage, waterproofing and placement of heavy planters or furniture.
Urban Patio does not provide structural engineering, electrical, plumbing, architectural certification or building approval services. Any specialist work required must be completed by appropriately qualified professionals.

All original design concepts, layouts, mood boards, sketches, styling proposals, written materials, images and branding created by Urban Patio remain our intellectual property unless otherwise agreed in writing.
Once all agreed fees have been paid, you may use the final approved design for your personal residential project. You may not reproduce, resell, distribute or commercially use our designs, plans or images without written permission.
Urban Patio will not use photographs of your completed space for marketing, website content or social media without your permission. Where you consent, we may use selected images while respecting any agreed privacy requirements.

To provide our services, we may collect information such as your name, phone number, email address, delivery location, photographs of your space, design preferences, measurements, project communications and payment confirmation details.
We use this information only as reasonably necessary to communicate with you, prepare proposals, deliver services, coordinate approved suppliers or deliveries, provide customer support and manage our business records.
Urban Patio will handle personal information in accordance with applicable Kenyan data protection requirements. Where necessary to complete your project, information may be shared with approved suppliers, delivery providers, installers or service partners only to the extent required for that purpose.

Urban Patio will provide its services with reasonable care and skill.
To the extent permitted by law, Urban Patio will not be responsible for indirect losses, loss of enjoyment caused by customer changes or delays outside our control, deterioration arising from improper care, damage caused by third-party installers or suppliers not directly controlled by us, or issues arising from inaccurate information provided by the customer.
Nothing in these Terms excludes liability for fraud, wilful misconduct, negligence causing injury, defective goods where liability cannot legally be excluded, or any other liability that cannot be limited under Kenyan law.

Urban Patio may update these Terms from time to time as our services grow or legal requirements change. The version that applies to your project will be the version accepted at the time you confirm your booking or approve your proposal, unless a change is required by law or agreed with you in writing.
